Can Out-of-State Medical Marijuana Card Holders Purchase Maine Cannabis?
On June 6th, 2019, PL 2019, ch. 209 [LD 538], an Act to Ensure Access to Medical Cannabis for Visiting Qualifying Patients went into effect. Medical Marijuana patients visiting Maine from out-of-state are now no longer required to provide certification from a Maine medical provider to designate a specific caregiver or storefront for the patient to obtain medical marijuana. Since 2019, medical cannabis patients visiting Maine can now simply show their state-issued documentation such as a registry identification card, certificate or other document proving status as a medical cannabis patient. The Office of Marijuana Policy (OMP) contacted states that have legalized medical marijuana to see who would authorize their patients to purchase medical cannabis in other states like Maine. An out-of-state user is only allowed to use their medical cannabis card to purchase cannabis in Maine if their state allows it.
Do Out-of-State Users Have Limitations on What They Can Purchase?
Cannabis products may vary from state to state in terms of texture, concentration, and CBD minimum / THC maximum allowed in Maine cannabis and cannabis products under Maine’s Medical Use of Marijuana Program. Out-of-state users must comply with limitations their state has regarding the delivery, quantity, or type of marijuana they are allowed to purchase or possess. In Maine, qualifying patients can purchase a selection of up to 2.5 ounces of medical cannabis and cannabis products every 15 days while in the state.
